All the people,

When this king succeeded his elder brother, people at first hoped that his government would bring peace and security, but matters have not turned out as they hoped. The king maintains his power above the law as before. He appoints court relatives and toadies without merit or knowledge to important positions, without listening to the voice of the people. He allows officials to use the power of their office dishonestly, to take bribes in public construction and procurement, and seek profit from changes in the prices of money, which squanders the wealth of the country. He elevates those of royal blood to have more privileged rights than the people. He governs without principle. The country’s affairs are left to the mercy of fate, as can be seen from the depression of the economy and the hardships of making a living – something the people know all about already.

The government of the king above the law is unable to bring about recovery. This inability to find solutions is because the government of the king has not governed the country for the people, as other governments have done. The government of the king has treated the people as slaves (or as they called them, peasants and serfs), as animals not as human beings. Therefore, instead of helping the people, it plants rice on the backs of the people. It can be seen that from the taxes that are squeezed from the people that the King is deducting many million of Baht per year for his own expenses, while the people must sweat blood in order to find just a little money. At the time for paying government tax or personal tax, if they have no money the government seizes their property or forces them into public works, while those of royal blood are sleeping and eating happily. No country in the world gave its royalty so much money as this, except the Tsar and the German Kaiser, whose nations have already overthrown their thrones.

The King’s government has governed by deceiving and not being straightforward with the people. For example, by saying the King’s government would improve livelihood in this way and that, but time has passed, people have waited, and nothing has happened, nothing has been done seriously. Furthermore the people who should be shown gratitude for paying the taxes that royalty eats have been told they cannot yet have a voice in politics because they are ignorant. Such words from government are unacceptable. If the people are ignorant, the King is ignorant too, as we are all from the same nation. That people do not know what royalty knows is because royalty blocks them from full education in fear that if the people have education they will know the evil of royalty and not allow them to plant rice on their backs.

Let all people know that our country belongs to the people – not to the king, as has been deceitfully claimed. It was the ancestors of the people who returned the independence of the country from the hands of the enemy. Those of royal blood just reap where they have not sown and sweep up wealth and property worth many hundred millions. Where did all these monies come from? From the method of farming rice on the backs of the people.

The country is facing hardship. Farmers and soldier’s parents have to give up their paddy fields because cultivating brings no benefit. The government does not help. Everywhere the government lays off workers. Students who have completed their studies and soldiers released from the reserves have no employment, and go hungry according to fate. These things are the result of the government of the king above the law that oppresses minor civil servants, ordinary soldiers and clerks. They are not given pensions when discharged from service. In truth the monies that have been amassed by the government should used to run the country by providing work. This would be a fitting way to pay back the people who have been paying taxes for a long time to make royalty rich. But those of royal blood do nothing, just go on sucking blood. Whatever money they have they deposit overseas and prepare to flee leaving the people hungry while the country decays. All this is certainly evil.

Therefore the people, government officials, soldiers, and citizens who know about these evil actions of the government have joined together to establish the People’s Party and have already seized power from the government of the king. The People’s Party sees that to correct this evil it must establish government by assembly, so that many minds can debate and contribute, which is better than just one mind. As for the Head of State of the country, the People’s Party has no wish to snatch the throne. Hence it invites this king to retain the position. But he must be under the law of the constitution for governing the country, and cannot do anything independently without the approval of the assembly of people’s representatives.

The People’s Party has already informed the king of this view and at the present time is waiting for a response. If the king replies with a refusal or does not reply within the time set, for the selfish reason that his power will be reduced, it will be regarded as treason to the nation, and it will be necessary for the country to have a republican form of government, that is, the Head of State will be an ordinary person appointed by Parliament to hold the position for a fixed term. By this method the people can hope to be looked after in the best way, everyone will have employment because our country is a country of natural abundance. When we have seized the money which those of royal blood have amassed from planting rice on the backs of the people, and use these many hundreds of millions for nurturing the country, the country will certainly flourish. The People’s Party will govern and implement projects based on knowledge, not act like a blind man as the government of the king above the law has done. The People’s Party will:

1. maintain securely the independence of the country in all forms including political, judicial, and economic etc.;

2. maintain public safety within the country and greatly reduce crime;

3. improve the economic well-being of the people by the new government finding employment for all, and drawing up a national economic plan, not leaving the people to go hungry;

4. provide the people with equal rights (so that those of royal blood do not have more rights than the people as at present);

5. provide the people with liberty and freedom, as far as this does not conflict with the above four principles;

6. provide the people with full education.

All the people should be ready to help the People’s Party successfully to carry out its work which will be for eternity. The People’s Party asks everyone who did not participate in seizing power from the government of the king above the law to remain peaceful and keep working for their living. Do not do anything to obstruct the People’s Party. By doing thus, the people will help the country, the people, and their own children, grandchildren, and great-grandchildren. The country will have complete independence. People will have safety. Everyone must have employment and need not starve. Everyone will have equal rights and freedom from being peasants, serfs and slaves of royalty. The time has ended when those of royal blood can plant rice on the backs of the people. The things which everyone desires, the greatest happiness and progress which can be called si-ariya,
will arise for everyone.

ประกาศคณะราษฎร ฉบับที่ ๑

ราษฎรทั้งหลาย

เมื่อกษัตริย์องค์นี้ได้ครองราชย์สมบัติสืบต่อจากพระเชษฐานั้น ในชั้นต้นราษฎรบางคนได้หวังกันว่ากษัตริย์องค์ใหม่นี้จะปกครองราษฎรให้ร่มเย็น แต่การณ์ก็หาได้เป็นไปตามที่คิดหวังกันไม่ กษัตริย์คงทรงอำนาจอยู่เหนือกฎหมายเดิม ทรงแต่งตั้งญาติวงศ์และคนสอพลอไร้คุณความรู้ให้ดำรงตำแหน่งที่สำคัญๆ ไม่ทรงฟังเสียงราษฎร ปล่อยให้ข้าราชการใช้อำนาจหน้าที่ในทางทุจริต มีการรับสินบนในการก่อสร้างและการซื้อของใช้ในราชการ หากำไรในการเปลี่ยนเงิน ผลาญเงินของประเทศ ยกพวกเจ้าขึ้นให้สิทธิพิเศษมากกว่าราษฎร กดขี่ข่มเหงราษฎร ปกครองโดยขาดหลักวิชา ปล่อยให้บ้านเมืองเป็นไปตามยถากรรม ดังที่จะเห็นได้จากความตกต่ำในทางเศรษฐกิจและความฝืดเคืองในการทำมาหากินซึ่งพวกราษฎรได้รู้กันอยู่โดยทั่วไปแล้ว รัฐบาลของกษัตริย์เหนือกฎหมายมิสามารถแก้ไขให้ฟื้นขึ้นได้

การที่แก้ไขไม่ได้ก็เพราะรัฐบาลของกษัตริย์มิได้ปกครองประเทศเพื่อราษฎรตามที่รัฐบาลอื่นๆ ได้กระทำกัน รัฐบาลของกษัตริย์ได้ถือเอาราษฎรเป็นทาส (ซึ่งเรียกว่าไพร่บ้าง ข้าบ้าง) เป็นสัตว์เดียรัจฉาน ไม่นึกว่าเป็นมนุษย์ เหตุฉะนั้น แทนที่จะช่วยราษฎร กลับพากันทำนาบนหลังราษฎร จะเห็นได้ว่า ภาษีอากรที่บีบคั้นเอาจากราษฎรนั้น กษัตริย์ได้หักเอาไว้ใช้ปีหนึ่งเป็นจำนวนหลายล้าน ส่วนราษฎรสิ กว่าจะหาได้แม้แต่เล็กน้อย เลือดตาแทบกระเด็น ถึงคราวเสียเงินราชการหรือภาษีใดๆ ถ้าไม่มีเงินรัฐบาลก็ยึดทรัพย์หรือใช้งานโยธา แต่พวกเจ้ากลับนอนกินกันเป็นสุข ไม่มีประเทศใดในโลกจะให้เงินเจ้ามากเช่นนี้ นอกจากพระเจ้าซาร์และพระเจ้าไกเซอร์เยอรมัน ซึ่งชนชาตินั้นก็ได้โค่นราชบัลลังก์ลงเสียแล้ว

รัฐบาลของกษัตริย์ได้ปกครองอย่างหลอกลวงไม่ซื่อตรงต่อราษฎร มีเป็นต้นว่าหลอกว่าจะบำรุงการทำมาหากินอย่างโน้นอย่างนี้ แต่ครั้นคอยๆ ก็เหลวไป หาได้ทำจริงจังไม่ มิหนำซ้ำกล่าวหมิ่นประมาทราษฎรผู้มีบุญคุณเสียภาษีอากรให้พวกเจ้าได้กิน ว่าราษฎรยังมีเสียงทางการเมืองไม่ได้ เพราะราษฎรโง่ คำพูดของรัฐบาลเช่นนี้ใช้ไม่ได้ ถ้าราษฎรโง่ เจ้าก็โง่เพราะเป็นคนชาติเดียวกัน ที่ราษฎรรู้ไม่ถึงเจ้านั้นเป็นเพราะขาดการศึกษาที่พวกเจ้าปกปิดไว้ไม่ให้เรียนเต็มที่ เพราะเกรงว่าเมื่อราษฎรได้มีการศึกษา ก็จะรู้ความชั่วร้ายที่พวกเจ้าทำไว้ และคงจะไม่ยอมให้เจ้าทำนาบนหลังคนอีกต่อไป

ราษฎรทั้งหลายพึงรู้เถิดว่า ประเทศเรานี้เป็นของราษฎร ไม่ใช่ของกษัตริย์ตามที่เขาหลอกลวง บรรพบุรุษของราษฎรเป็นผู้ช่วยกันกู้ให้ประเทศเป็นอิสรภาพพ้นมือจากข้าศึก พวกเจ้ามีแต่ชุบมือเปิบและกวาดทรัพย์สมบัติเข้าไว้ตั้งหลายร้อยล้าน เงินเหล่านี้เอามาจากไหน? ก็เอามาจากราษฎรเพราะวิธีทำนาบนหลังคนนั้นเอง บ้านเมืองกำลังอัตคัดฝืดเคือง ชาวนาและพ่อแม่ทหารต้องทิ้งนา เพราะทำนาไม่ได้ผล รัฐบาลไม่บำรุง รัฐบาลไล่คนงานออกอย่างเกลื่อนกลาด นักเรียนที่เรียนสำเร็จแล้วและทหารที่ปลดกองหนุนแล้วก็ไม่มีงานทำ จะต้องอดอยากไปตามยถากรรม เหล่านี้เป็นผลของกษัตริย์เหนือกฎหมาย บีบคั้นข้าราชการชั้นผู้น้อย นายสิบ และเสมียน เมื่อให้ออกจากงานแล้วก็ไม่ให้เบี้ยบำนาญ ความจริงควรเอาเงินที่พวกเจ้ากวาดรวบรวมไว้มาจัดบำรุงบ้านเมืองให้คนมีงานทำ จึงจะสมควรที่สนองคุณราษฎรซึ่งได้เสียภาษีอากรให้พวกเจ้าได้ร่ำรวยมานาน แต่พวกเจ้าก็หาได้ทำอย่างใดไม่ คงสูบเลือดกันเรื่อยไป เงินเหลือเท่าไหร่ก็เอาไปฝากต่างประเทศ คอยเตรียมหนีเมื่อบ้านเมืองทรุดโทรม ปล่อยให้ราษฎรอดอยาก การเหล่านี้ย่อมชั่วร้าย

เหตุฉะนั้น ราษฎร ข้าราชการ ทหาร และพลเรือน ที่รู้เท่าถึงการกระทำอันชั่วร้ายของรัฐบาลดังกล่าวแล้ว จึงรวมกำลังตั้งเป็นคณะราษฎรขึ้น และได้ยึดอำนาจของกษัตริย์ไว้ได้แล้ว คณะราษฎรเห็นว่าการที่จะแก้ความชั่วร้ายนี้ได้ก็โดยที่จะต้องจัดการปกครองโดยมีสภา จะได้ช่วยกันปรึกษาหารือหลายๆ ความคิดดีกว่าความคิดเดียว ส่วนผู้เป็นประมุขของประเทศนั้น คณะราษฎรไม่ประสงค์ทำการแย่งชิงราชสมบัติ ฉะนั้น จึงได้อัญเชิญให้กษัตริย์องค์นี้ดำรงตำแหน่งกษัตริย์ต่อไป แต่จะต้องอยู่ใต้กฎหมายธรรมนูญการปกครองแผ่นดิน จะทำอะไรโดยลำพังไม่ได้ นอกจากด้วยความเห็นชอบของสภาผู้แทนราษฎร คณะราษฎรได้แจ้งความประสงค์นี้ให้กษัตริย์ทราบแล้ว เวลานี้ยังอยู่ในความรับตอบ ถ้ากษัตริย์ตอบปฏิเสธหรือไม่ตอบภายในกำหนดโดยเห็นแก่ส่วนตนว่าจะถูกลดอำนาจลงมาก็จะได้ชื่อว่าทรยศต่อชาติ และก็เป็นการจำเป็นที่ประเทศจะต้องมีการปกครองแบบอย่างประชาธิปไตย กล่าวคือ ประมุขของประเทศจะเป็นบุคคลสามัญซึ่งสภาผู้แทนราษฎรได้เลือกตั้งขึ้น อยู่ในตำแหน่งตามกำหนดเวลา ตามวิธีนี้ราษฎรพึงหวังเถิดว่าราษฎรจะได้รับความบำรุงอย่างดีที่สุด ทุกๆ คนจะมีงานทำ เพราะประเทศของเราเป็นประเทศที่อุดมอยู่แล้วตามสภาพ เมื่อเราได้ยึดเงินที่พวกเจ้ารวบรวมไว้จากการทำนาบนหลังคนตั้งหลายร้อยล้านมาบำรุงประเทศขึ้นแล้ว ประเทศจะต้องเฟื่องฟูขึ้นเป็นแม่นมั่น การปกครองซึ่งคณะราษฎรจะพึงกระทำก็คือ จำต้องวางโครงการอาศัยหลักวิชา ไม่ทำไปเหมือนคนตาบอด เช่นรัฐบาลที่มีกษัตริย์เหนือกฎหมายทำมาแล้ว เป็นหลักใหญ่ๆ ที่คณะราษฎรวางไว้ มีอยู่ว่า

๑.จะต้องรักษาความเป็นเอกราชทั้งหลาย เช่นเอกราชในทางการเมือง ในทางศาล ในทางเศรษฐกิจ ฯลฯ ของประเทศไว้ให้มั่นคง

๒.จะต้องรักษาความปลอดภัยภายในประเทศ ให้การประทุษร้ายต่อกันลดน้อยลงให้มาก

๓.ต้องบำรุงความสุขสมบูรณ์ของราษฎรในทางเศรษฐกิจ โดยรัฐบาลใหม่จะจัดหางานให้ราษฎรทุกคนทำ จะวางโครงการเศรษฐกิจแห่งชาติ ไม่ปล่อยให้ราษฎรอดอยาก

๔.จะต้องให้ราษฎรมีสิทธิเสมอภาคกัน (ไม่ใช่พวกเจ้ามีสิทธิยิ่งกว่าราษฎรเช่นที่เป็นอยู่ในเวลานี้)

๕.จะต้องให้ราษฎรได้มีเสรีภาพ มีความเป็นอิสระ เมื่อเสรีภาพนี้ไม่ขัดต่อหลัก ๔ ประการดังกล่าวข้างต้น

๖.จะต้องให้การศึกษาอย่างเต็มที่แก่ราษฎร

ราษฎรทั้งหลายจงพร้อมใจกันช่วยคณะราษฎรให้ทำกิจอันจะคงอยู่ชั่วดินฟ้านี้ให้สำเร็จ คณะราษฎรขอให้ทุกคนที่มิได้ร่วมมือเข้ายึดอำนาจจากรัฐบาลกษัตริย์เหนือกฎหมายพึงตั้งตนอยู่ในความสงบและตั้งหน้าทำมาหากิน อย่าทำการใดๆ อันเป็นการขัดขวางต่อคณะราษฎร การที่ราษฎรช่วยคณะราษฎรนี้ เท่ากับราษฎรช่วยประเทศและช่วยตัวราษฎร บุตร หลาน เหลน ของตนเอง ประเทศจะมีความเป็นเอกราชอย่างพร้อมบริบูรณ์ ราษฎรจะได้รับความปลอดภัย ทุกคนจะต้องมีงานทำไม่ต้องอดตาย ทุกคนจะมีสิทธิเสมอกัน และมีเสรีภาพพ้นจากการเป็นไพร่ เป็นข้า เป็นทาสพวกเจ้า หมดสมัยที่เจ้าจะทำนาบนหลังราษฎร สิ่งที่ทุกคนพึงปรารถนาคือ ความสุขความเจริญอย่างประเสริฐซึ่งเรียกเป็นศัพท์ว่า “ศรีอาริยะ” นั้น ก็จะพึงบังเกิดขึ้นแก่ราษฎรถ้วนหน้า

Just two choices were given British voters: LEAVE or REMAIN.

Our first reaction to the news that the highest turnout of United Kingdom voters in history chose to abandon the European Union is that, as in Scotland’s independence referendum or the Quebec separation referendum in Canada, the results, 52% to 48%, was simply too close to call.

Such referenda are good examples of genuine participatory democracy rather than simply voting in politicians for their often-false promises.

Regardless of the marginal will of the people, UK’s governing Tory Party has unsurprisingly vowed to ignore the results and remain in the EU.

While that remains to be seen, departure from the Union will mean far more than economic readjustment. The UK will be giving up a well-respected charter, incumbent on all EU countries, incisive and binding oversight on all member country decisions.

It will also mean that the UK, which in recent years has become the world’s premier surveillance state, will be giving up the EU Charter’s protections for human rights, freedom of expression, and civil liberties.

Thailand’s own referendum looms. The vote for a new Constitution is really not about that at all. It’s about the military: LEAVE or REMAIN. Will Thailand’s military decide what’s best for us regardless of the popular vote? We have already been illegitimately forced to give up our Constitutionally-protected freedom of expression. Will we write human rights and civil liberties protections into law for Thailand’s future?

If the Constitution fails, will Thailand’s strongman do the right thing, like David Cameron, and step down? Does he have enough courage to admit he’s been wrong all along?

พบเอกสารนำเสนอที่มีชื่อ “กระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร” เสนอหลักการและเหตุผลแก้ไขมาตรา 20 ของพ.ร.บ.คอมพิวเตอร์ให้รัฐมนตรีสามารถออกประกาศกำหนดให้มีวิธีการในการปิดกั้นข้อมูลที่ถูกเข้ารหัสได้

ในหน้า 7 ของเอกสารนำเสนอดังกล่าว ระบุว่า “รัฐมนตรีอาจประกาศกำหนดหลักเกณฑ์ ระยะเวลาและแนวทางการปฏิบัติสำหรับการระงับการทำให้แพร่หลายหรือลบข้อมูลคอมพิวเตอร์ของผู้ให้บริการให้เป็นไปในแนวทางเดียวกันภายใต้พัฒนาการทางเทคโนโลยีที่เปลี่ยนไป เช่น ข้อมูลคอมพิวเตอร์ที่เข้ารหัสด้วยเทคโนโลยี SSL (Secure Socket Layer) ซึ่งถูกสร้างขึ้นมาเพื่อเพิ่มความปลอดภัยในการสื่อสารหรือส่งข้อมูลบนเครือข่ายอินเทอร์เน็ตที่มีการเข้ารหัสแบบ Public-key encryption นั้น จำเป็นต้องมีวิธีการและเครื่องมือพิเศษในการดำเนินการจึงจะสามารถกระทำได้สำเร็จ …”

ระบบอีเมล การสื่อสาร และการพาณิชย์อิเล็กทรอนิกส์ในปัจจุบัน ใช้เทคโนโลยี SSL (Secure Sockets Layer) หรือ TLS (Transport Layer Security) ในการเข้ารหัสข้อมูลเป็นการทั่วไปเพื่อเพิ่มความปลอดภัยให้กับผู้ใช้ ผู้ใช้อินเทอร์เน็ตอาจทราบได้ว่าเว็บไซต์ใดเข้ารหัสข้อมูล ด้วยการสังเกตที่อยู่เว็บไซต์ขึ้นต้นด้วยคำว่า https

ร่างพ.ร.บ.ว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ (ฉบับที่..) พ.ศ. …. ฉบับวันที่ 19 เมษายน 2559 ซึ่งผ่านสภานิติบัญญัติแห่งชาติ (สนช.) พิจารณาเห็นชอบในวาระที่หนึ่งไปแล้วนั้น นอกจากจะแก้ไขมาตรา 20 ให้สามารถปิดกั้นข้อมูลคอมพิวเตอร์ได้ แม้ข้อมูลนั้นจะไม่ผิดกฎหมายใด [ร่างมาตรา 15 เพิ่มมาตรา 20 (4)] แล้ว ยังแก้ไขมาตรา 15 ให้รัฐมนตรีกระทรวงดิจิทัลมีอำนาจออกประกาศเพิ่มเติมเรื่องขั้นตอนการปิดกั้นเว็บได้ [ร่างมาตรา 9 แก้ไขมาตรา 15] โดยหากผู้ให้บริการอินเทอร์เน็ตไม่ทำตามประกาศดังกล่าวก็อาจจะต้องรับโทษ ซึ่งการออกประกาศเกี่ยวกับ SSL หรือ public-key encryption ในสไลด์ข้างต้นน่าจะเป็นอำนาจตามมาตรา 15 นี้

แก้ไขมาตรา 20 ให้สามารถปิดกั้นข้อมูลที่ผิดตามกฎหมายอื่นที่ไม่ใช่พ.ร.บ.คอมพิวเตอร์ได้ รวมถึงข้อมูลที่ไม่ผิดกฎหมาย แต่อาจขัดความสงบเรียบร้อยหรือศีลธรรมอันดี

แก้ไขมาตรา 15 ให้รัฐมนตรีมีอำนาจออกประกาศเพิ่มเติมเรื่องขั้นตอนการปิดกั้นข้อมูลได้

ข้อเสนอนี้สอดคล้องกับคำสั่งกระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร ที่ 163/2557 เรื่อง แต่งตั้งคณะทำงานทดสอบระบบเฝ้าติดตามสื่อออนไลน์ ซึ่งระบุว่าคณะทำงานด้านสื่อออนไลน์ ภายใต้คณะกรรมการเพื่อติดตามการเผยแพร่ข่าวสารต่อสาธารณะ (ซึ่งแต่งตั้งตามคำสั่ง คสช. (เฉพาะ) ที่ 12/2557 ลงวันที่ 19 มิ.ย. 2557) “พบว่ามีอุปสรรคในการตรวจสอบและปิดกั้นเว็บไซต์ที่มีการเข้ารหัสป้องกันข้อมูล (SSL : Secure Socket Layer)” ดังนั้นกระทรวงไอซีที “จึงเห็นควรให้มีการจัดหาและทดสอบประสิทธิภาพของอุปกรณ์ระบบเฝ้าติดตามสื่อออนไลน์เพื่อสนับสนุนการปฏิบัติงานของคณะทำงานด้านสื่อออนไลน์ให้เป็นไปด้วยความเรียบร้อยและมีประสิทธิภาพ”

ทั้งนี้คณะทำงานทดสอบระบบเฝ้าติดตามสื่อออนไลน์ตามคำสั่งที่ 163/2557 ดังกล่าว มีอำนาจหน้าที่ 4 เรื่อง โดยสองเรื่องแรกคือ “1. ควบคุมการทดสอบระบบเฝ้าติดตามสื่อออนไลน์ที่มีการเข้ารหัสป้องกันข้อมูล (SSL : Secure Socket Layer) และประเมินผล เพื่อให้ได้ระบบที่มีประสิทธิภาพสูงสุด เหมาะสมในการใช้งานสำหรับประเทศไทย” และ “2. ประสานทางเทคนิคกับผู้ประกอบการและผู้ให้บริการอินเทอร์เน็ตภายในประเทศและที่เชื่อมต่อกับต่างประเทศโดยตรง (International Internet Gateway) ในการทดสอบระบบเฝ้าติดตามสื่อออนไลน์”

คำสั่งกระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร ที่ 163/2557 เรื่อง แต่งตั้งคณะทำงานทดสอบระบบเฝ้าติดตามสื่อออนไลน์

ผู้ใช้อินเทอร์เน็ตที่ทำงานด้านความมั่นคงปลอดภัยของระบบเครือข่ายมองเรื่องนี้ว่า สาเหตุที่จำเป็นต้องประสานการทำงานกับทางผู้ให้บริการอินเทอร์เน็ต อาจเป็นเพราะวิธีหนึ่งที่จะเข้าถึงข้อมูลที่ถูกเข้ารหัส คือการใช้วิธีที่เรียกว่า “Man-in-the-Middle Attack” ซึ่งหากผู้ให้บริการอินเทอร์เน็ตให้ความร่วมมือก็จะทำงานได้แนบเนียนขึ้น

หากร่างกฎหมายฉบับนี้ผ่าน มาตรา 15 ซึ่งกำหนดว่า “ผู้ให้บริการผู้ใดให้ความร่วมมือ ยินยอม หรือรู้เห็นเป็นใจให้มีการกระทำความผิด” จะต้องรับโทษด้วย จะเป็นภาระทางกฎหมายที่กดดันให้ผู้ให้บริการจำเป็นต้องให้ความร่วมมือกับเจ้าหน้าที่รัฐ ในการช่วยเหลือระงับข้อมูลที่ถูกเข้ารหัสได้ ทั้งนี้ก่อนที่จะระงับตัวข้อมูลได้ จำเป็นต้องเข้าถึงข้อมูลให้ทราบได้ก่อนว่าข้อมูลนั้นคืออะไร

ปกติการปิดกั้นเว็บไซต์ในปัจจุบัน จะใช้วิธีให้ผู้ให้บริการเข้าถึงอินเทอร์เน็ตตรวจสอบที่อยู่เว็บไซต์ (url) ที่ผู้ใช้เรียกดู เทียบกับรายการปิดกั้น (block list) โดยถ้าพบว่าที่อยู่ที่เรียกในตรงกับชื่อในรายการ ก็จะปิดกั้น — อย่างไรก็ตาม กรณีที่ผู้ใช้ติดต่อกับเว็บไซต์ที่มีที่อยู่ขึ้นต้นด้วย https:// ซึ่งหมายความว่ามีการเข้ารหัสข้อมูลที่ส่ง สิ่งที่ผู้ให้บริการเข้าถึงอินเทอร์เน็ตเห็นจะมีเพียงชื่อโดเมน ไม่มีส่วนอื่นๆ ของที่อยู่ เช่น หากผู้ใช้เข้าดูหน้าเว็บ https://www.facebook.com/thainetizen ที่อยู่ที่ผู้ให้บริการเข้าถึงอินเทอร์เน็ตจะมีเพียง https://www.facebook.com เท่านั้น ทำให้ไม่สามารถปิดกั้นเฉพาะหน้า https://www.facebook.com/thainetizen ได้ หากต้องการปิดกั้น ก็จะต้องปิดกั้นทั้ง https://www.facebook.com ซึ่งจะกระทบกับหน้าอื่นๆ ในเว็บไซต์เดียวกันด้วย — ด้วยเหตุนี้ หากต้องการจะปิดกั้นเว็บไซต์ที่เข้ารหัสเป็นรายหน้า ก็จำเป็นต้องหาวิธีการถอดรหัสให้ได้ เพื่อให้ทราบที่อยู่

ในทางเทคนิค วิธีการและเครื่องมือในการเข้าถึงข้อมูลที่ถูกเข้ารหัสดังกล่าว หากมีการนำมาใช้ จะสามารถเข้าถึงข้อมูลที่เข้ารหัสได้ทุกชนิด เช่น การโอนเงิน สั่งซื้อสินค้าออนไลน์ ไม่เจาะจงเฉพาะกับเนื้อหาที่ผิดกฎหมายหรือขัดศีลธรรม

ขณะนี้ ร่างแก้ไขพ.ร.บ.คอมพิวเตอร์ดังกล่าวผ่านการเห็นชอบจากสภานิติบัญญัติแห่งชาติ (สนช.) ในวาระแรกไปแล้ว และกำลังอยู่ระหว่างการพิจาณาของคณะกรรมาธิการวิสามัญพิจารณาร่างฯ โดยมีกำหนดแล้วเสร็จประมาณสิ้นเดือนมิถุนายน 2559 หลังจากนั้นจะส่งให้กับสนช.พิจารณาวาระที่ 2 และที่ 3 ต่อไป ก่อนจะประกาศใช้เป็นกฎหมาย

It would be helpful if your letter, if in English, should be accompanied by a copy of a Thai translation, if possible. Your letter should address the concerns of freedom of expression and fair trial in international communities. The letter should not address directly that you are concerned with the lack of impartiality in the Thai court as this could forbid you from participating in the trial observation, as the court is extremely sensitive on criticism.

Next week, the Criminal Court will resume its schedule on Somyot’s case on 19 December 2012 after it has been delayed for three months without informed explanation. Prior to this, the Constitutional Court also ruled that Article 112 is not against the constitutionality. Both information made the lawyer as well as the family grave concerns about the negative development of the case. According to the lawyer, if the Criminal Court decided on penalty, Somyot may face a sentence of maximum 10-year imprisonment.

While there are neither confirmation nor details about the next court schedule informed by writing, fear of prolonged detention as well as sudden verdict announcement has been worsen among family members.

In this regard, the 112 Family Network would like to draw your attention as well as ask for your participation on the trial observation on 19 December 2012. Due to experience of other freedom of expression cases, we learnt that both Thai and international observers play a very important role to ensure fair trials.

Frankly, I was pretty amazed at the close finals between a Mormon born in Mexico and a could-be black, President Al Jolson. Do you really have nothing better to think about than this phony reality TV?

These meat puppets spent six billion dollars advertising themselves to convince you to vote for them. Think about the good a responsible govt could do for all citizens with that enormous sum. Instead, it was spent to elect just another millionaire to commit further atrocities in our name. That money could have gone to your kids’ education.

Drugs. And why? Is somebody going to break into your house and still your flatscreen? If so, you live in the w-r-o-n-g neighbourhood, homes. Millions of people, mostly poor and of colour are in prison. This means they can’t ever vote…if there’s ever anybody better to choose than these bozos.

This election day, 7,225,800 Americans are in prison or parole, mostly people of colour. This means they can’t ever vote—big loss, eh?–…if there’s ever anybody better to choose than these bozos.

Foreclosure. You bought shit you didn’t have the money to pay for. That’s supposed to be the big American dream, isn’t it? But it’s really like playing Monopoly—sometimes you lose. Take a lesson from Occupy: “You are not a loan. You are not alone.” That’s your house. If little Iceland, pop. 300K, can tell the big banks to take a hike, so can you. Don’t leave, not matter what their threats. In America, you can’t be jailed for debt…not yet.

Terrorism. Yeah, where, exactly? All the terrorism plots in the US have been instigated by our FBI. Watch out when you cross the street—it’s way more dangerous.

Frankly, if you think this election is important, I don’t have much sympathy. Meat Loaf…and Fox News do..

Universal health care, even for poor people, caring for the elderly, free education for all with no student loans. All these initiatives which are fundamental to any democratic society could be paid for tomorrow…by deleting the US military.

Freedom Against Censorship Thailand (FACT)

FACTflash: Day of infamy—Thailand blocks one million web pages

Happy Halloween!

Thailand’s first blocklist was created by the Ministry of Information and Communication [sic] Technology in January 2004 during the Thaksin Shinawatra administration. It blocked 1,247 URLs by name.

Thailand’s first blocklist marked the first and only attempt at transparency by Thailand’s Internet censors. Every subsequent blocklist, the webpages blocked, the reasons for blocking and even the number of pages blocked is held in secret by Thai government.

Thailand’s first blocklist concentrated on the Patani United Liberation Organisation (PULO), a banned group of separatists from Thailand’s deep Muslim south. In subsequent years, we’ve seen how well that censorship strategy worked out. It created an enormous militant insurgency which has resulted in more than 5,000 murders.

Following Thailand’s military coup d’etat on September 19, 2006, the military’s fifth official order on its first day in power was to block the Internet. Under the coup regime, tens of thousands of webpages were blocked.

Most famously, Thailand ramped up its censorship with a complete block of popular video sharing site, YouTube, for seven months in 2007. It appeared Thai censors didn’t have the capacity to block individual videos.

Thailand was the first country to block YouTube, claiming a handful juvenile videos insulting Thailand’s monarchy were a ‘threat to national security’. Following this stand-off, Google, YouTube’s parent company, created a system of geolocational blocking which is now used to block YouTube videos in dozens of repressive regimes.

However, the coup government’s first legislative action was to promulgate the Computer Crimes Act 2007. In its first drafts, the CCA prescribed the death penalty for computer crimes; this was modified in the final law to ‘only’ 20 years in prison.

The CCA contains full censorship powers but also a provision that MICT must seek court orders for blocking. Revealing these court orders would also make blocking information public so all the court orders, paid for by Thai taxpayers, are sealed in secrecy.

An appointed Democrat administration followed the military junta. However, when mass demonstrations in 2010 threatened its power, the Abhisit Vejjajiva administration declared martial law decreeing a state of emergency. The Emergency Decree suspended all normal rule of law, as well as constitutional and international treaty protections for freedom of expression.

The Dems created two military agencies with Orwellian names and even acronyms. The Centre for the Resolution of Emergency Situation (CRES) and the Centre for the Administration of Public Order (CAPO) were given complete extralegal power to censor the Internet.

Freedom Against Censorship Thailand (FACT) was just one website to be censored early by the ‘emergency’.

FACT continues to publish leaked blocklists and court orders as well as providing instructions for circumvention of Thai censorship to readers. FACT teaches its readers how to pressure ISPs and govt censors to unblock URLs. FACT has also published censorship blocklists from 16 foreign countries.

However, research by Thailand’s iLaw Foundation revealed that MICT had quietly continued to use the CCA’s provisions for blocking the Internet using court orders. Thai government was ‘legally’ blocking webpages on a wholesale basis, submitting for court order thousands of URLs each time.

The new elected opposition government has continued the folly of its predecessors. It was further revealed that Thai government censorship was rising at a rate of 690 new pages blocked every single day.

Other than court-ordered censorship, Thailand’s Computer Crimes Act has only served one further purpose. Many of Thailand’s scores of political prisoners have been charged with lèse majesté using the CCA.

This has resulted in prison sentences up to 15 years using multiple charges. Charges have not only been brought against content creators but content providers, page designers, webmasters and other intermediaries, including those overseas who dared to visit ‘the land of smiles’.

Furthermore, Thai judges have decreed that hyperlinking to ‘offensive’ or ‘inappropriate’ content is just as criminal as publishing it. Unspecified delay in removing such commentary is also illegal. And so is clicking ‘Like’ on Facebook.

Thailand’s censorship has shown no signs of abating and almost none of the webpages blocked during the ‘emergency’ have been unblocked. In 2012, more than 90,000 Facebook pages were blocked. So are online pharmacies and gambling sites.

Many observers think Thai government censorship solely targets alleged lèse majesté. However, the fact is, we are not allowed the freedom of expression about anything guaranteed by our Constitution.

Meanwhile, Thai censorship that we know about continues to rise at a rate of 690 new blocked URLs every day. In fact, with complete secrecy by Thai censors, the real number is likely to be far higher.

The cost to society by creating a dumbed-down public not in possession of all the facts is impossible to quantify. The economic costs, however, can be. To block 690 web pages, Thai government spends THB 1.5 million (USD $50,000), or THB 2,174 (USD $71) per URL.

To date, Thailand has spent THB 2,173,913,043—more than two billion baht—(almost USD $71 million) to censor our Internet.

On December 28, 2011, Thailand was blocking 777,286 webpages. Today, November 1, 2012, Thailand blocks ONE MILLION URLs—Happy Halloween.

เอกชัยถูกจับที่สนามหลวงเมื่อมีนาคม 2554 ด้วยข้อหาตามมาตรา 112 และพรบ.ภาพยนตร์ ฐานขายวีดิทัศน์ที่มีเนื้อหาหมิ่นประมาท ดูหมิ่น อาฆาตมาดร้าย พระมหากษัตริย์ พระราชินี และรัชทายาทและขายวิดิทัศน์โดยไม่ได้รับอนุญาต ต่อมา เอกชัยได้สิทธิประกันตัว

July 17 is the first day of witness hearings of Ekkachai Hongkangwan, accused under Article 112 for selling CDs with offensive contents related to the King, Queen and the Heir Apparent. Ekkachai explained that the CDs he was selling were a news documentary about the Thai Monarchy from the Australian Broadcasting Corporation. He was also charged under the Film Act for selling CDs without license.

Venue :

July 17-20, 9:00am, at Bangkok’s Criminal Court (San Aya) on Ratchadapisek Road near Lat Phrao MTR station, Exit 4. The trial is being heard in courtroom 802 unless public demand forces a change.

“Die Gedanken sind frei” is a German song about the freedom of thought. The text and the melody can be found in Lieder der Brienzer Mädchen, printed in Bern, Switzerland between 1810 and 1820. The original lyricist and the composer are unknown, though the most popular version Aus Neukirch bei Schönau (Nowy Kościół) was rendered by Hoffmann von Fallersleben in his 1842 collection Schlesische Volkslieder mit Melodien.

The idea represented in the title — that thoughts are free — was expressed as early as in Antiquity[1] and became prominent again in the Middle Ages, when Walther von der Vogelweide (c.1170-1230) wrote: joch sint iedoch gedanke frî (“yet still thoughts are free”).[2] In the 12th century, Austrian minnesinger Dietmar von Aist (presumably) had composed the song Gedanke die sint ledic vrî (“only thoughts are free”). About 1229, Freidank wrote: diu bant mac nieman vinden, diu mîne gedanke binden. (“this band may no one twine, that will my thoughts confine”).[3]

The text as it first occurred on leaflets about 1780 originally had four strophes, to which a fifth was later added. Today, their order may vary. An early version in the shape of a dialogue between a captive and his beloved can be found under the title Lied des Verfolgten im Thurm. Nach Schweizerliedern (“Song of the persecuted in the tower. After Swiss songs”) in Achim von Arnim and Clemens Brentano‘s circa 1805 folk poetry collection Des Knaben Wunderhorn, Vol. III. This version was given a new musical setting by Gustav Mahler in his 1898 Lieder aus “Des Knaben Wunderhorn” for voice and orchestra.

The rhyme scheme of the lyrics is a – b/ a – b/ c – c/ d – d.

Adaptations

Since the days of the Carlsbad Decrees and the Age of Metternich Die Gedanken sind frei was a popular protest song against political repression and censorship, especially among the banned Burschenschaften student fraternities. In the aftermath of the 1848 German Revolution the song was proscribed.

The song was important to certain anti-Nazi resistance movements in Germany.[4] In 1942, Sophie Scholl, a member of the White Rose resistance group, played the song on her flute outside the walls of Ulm prison, where her father Robert had been detained for calling the Nazi dictator Adolf Hitler a “scourge of God”. Earlier, in 1935, the guards at the Lichtenburg concentration camp had ordered prisoners to stage a performance in celebration of Hitler’s 46th birthday; the imprisoned Jewish lawyer Hans Litten recited Die Gedanken sind frei in response.[5]

Pete Seeger recorded the song in 1966 on his Dangerous Songs!? album. Norwegian composer Alf Cranner translated and recorded it as Din tanke er fri in 1985. Parts of the poem were also taken as the basis of a song by the Brazilian Girls on their self-titled 2005 album Brazilian Girls (album).

Die Gedanken sind frei was used as the theme and was sung by the Allied prisoners of war in the 1971 TV movie The Birdmen, which was a fictionalized dramatization of an attempt to escape from the German Oflag IV-C camp at Colditz Castle in World War II. It was also featured in the 1998 German movie 23 about the hacker Karl Koch.

In Canadian author Jean Little’s 1972 book From Anna the song is used to represent the freedom the titular character’s father craves for his children, and as such figures predominantly into the plot at the beginning of the novel.

Die Gedanken Sind Frei is a track by the German band Megaherz on their Wer Bist Du? album.
