FACT rebuts Justice Minister

CJ Hinke of FACT comments: I was very pleased to read the Justice Minister’s remarks which are a wonderful introduction to Thais’ affection for the King and Queen. But then the Minister spoiled it by getting aggressive. Wars (and war rooms) don’t work in the modern world.

What we need to accomplish is a lasting peace in our society, building common bridges between people, and this will not happen if government starts out on a war footing. Let’s look at all those other unsuccessful wars: terrorism, drugs, pornography.

The government is wrong to create enemies when there are none. All the freedom of expression groups working against censorship and lèse majesté are not doing this because we support defamation of the King or anyone else. Nor do we have any interest in changing our Constitutional monarchy.

But I think we should look at the order of those words. They do not say, monarchial Constitution. Both Constitution and monarch lead the country in order to protect the people, not criminalise them. The minister invokes “national security” which, undefined, leaves far too much room for government excess and abuse.

I have been involved as an academic in censorship issues in Thailand for more than a decade. If anyone might, I think I would know if there were any organised movement to bring down the monarchy. This is a paranoid fantasy.

Yes, there are a few lone crackpots out there, all Thais to my knowledge, who directly and intentionally insult the monarchy. But there is certainly no movement! Furthermore, none of the efforts I have seen could convince any of us against the King.

So when the minister asks why “the movement” is growing over the last two or three years, the real movement he’s talking about is the government movement to find lèse majesté under every rock and behind every tree! There is a great difference between real lèse majesté and imaginary insults.

For the first time, the international Thai Studies Conference in 2008 discussed the monarchy, including The King Never Smiles. Police were in attendance at these panels. The same is true for web discussion boards. Thai people have every human and Constitutional right to discuss the monarchy.

But government must stop presuming insult where there is none. The BBC, The Economist, The Guardian, Newsweek, are not insulting Thai monarchy. They are trying to understand it and find ways to explain it. The same is true for The King Never Smiles; the book simply does not insult the monarchy.

For all those who want Paul Handley’s blood, I must ask: have you read the book for yourself??? Both academics Sulak Sivaraksa and Giles Ji Ungphakorn have been charged with lèse majesté for no other reason than they had the unmitigated audacity to reference The King Never Smiles!

The minister states there have been “continuous” lèse majesté arrests but he doesn’t want them in the public media, nor does he want the closure of websites to become public knowledge.

Secret arrests, disappearance in the dead of night, denial of bail, long prison sentences for dissenters, suppression of news, government in secret. These are hallmarks of tyrannical regimes not Constitutional states and not modern monarchies. We should actually listen to the King.

Disregarding His Majesty’s wise counsel is the highest form of lèse majesté. All else is just vain flattery and ingratiation.

The definition of lèse majesté is bringing the monarchy into disrepute. Thai bureaucrats, politicians and martinets have done more damage to the honour of the King through spurious lèse majesté charges than 1000 YouTube videos.

The justice minister states quite clearly that, if lèse majesté is not intended, then it is not criminal. What about Harry Nicolaides?

The Minister of Justice announced, “We will expedite cases related to our nation’s highest institution whether in the form of acts, speech, any sort of communication or website.”

Mr. Phiraphant Saleeratwipak, Minister of Justice, made a policy announcement regarding the administration of his ministry on his first day at work, that he would speed up carrying out suppression relating to cases about the nation’s highest institution no matter whether acts, speech, any form of communication or website – this is an important task of the Ministry of Justice.

Subsequently the Criminal Court issued a judgment sentencing to prison Australian national Mr. Harry Nicolaides under the charge of insulting, defaming, or demonstrating malice toward the king, and heir apparent according to Article 112 of the Criminal Code.

Today a month has passed. Mr. Phiraphant Saleeratwipak, Minister of Justice, gave a special interview with Krungthep Thurikij regarding policies dealing with the movement defaming the monarchy through websites and other media up to and including those who committed insults and encroached on the institution, that at this time foreigners are confused and think that this type of issue is a matter of rights and liberty. Therefore media and those concerned must produce a new understanding among them that offense against the monarchy is offense against the kingdom’s security. It’s not a matter of showing opinion or ordinary criticism. But western media do not attach the same affection for their major institutions as Thais feel affection.

The Minister also stated, “Both foreigners or Thais must be aware of this, that if Thailand did not have the monarchy, just how would Thailand be today? So I see that this is the problem of the kingdom’s security and not a matter of rights and freedom. Therefore those who commit offenses do not commit personal offenses but offenses against national security.”

All this relating to state security, each country retains its own definition, each country has its own internal reasons, such as the United States has numerous provisions regarding travel abroad, because they feel those are standards that provide the state with security from various dangers, but as for Thailand, we specify guilt in matters involving insults to the monarchy in Article 112 of the Criminal Code in sections about national security.

The Minister of Justice spoke on various human rights that human rights activists must give consideration toward offending the mindset of the Thai people. We are loyal to and worship the monarchy. We share a fondness of the heart and [have bestowed upon them – the king and queen – the role of] father and mother of the nation. We don’t need much, just our father and mother. Let anybody shout at our father and mother…ridicule our mother…can we let them do that?

At this time in our criticisms we must view whether the act is intentional or not. If lèse majesté is intentional, or no matter how it was said is insulting, if it’s not intentional then, no matter what, it’s not wrong. Because criminal law in this [kind of] defamation case arises from this basis, that is, is there intent to slander the monarchy or to introduce into speech something that is not true. Therefore, [for] those who commit this offense there are many kinds, arising from obtaining wrong information, so we have to explain [it] to them. But another kind of person has intent to insult the monarchy directly by making other people misunderstand. If this is the case it can be deemed that they intend to insult the monarchy.

Therefore, Thai people who are loyal they wonder why are state officers letting these people go. These people come and say things against father and mother of our land. It will be noted that in the last two to three years why has it spread and mushroomed?

Mr. Phiraphant stressed that we Thai are a small country but we have our own culture. Ask if we’re wrong in this foreigners will understand we are wrong, mixing it with pointing out we are wrong, doing it as a movement.

Therefore, it is the duty of the Ministry of Justice and those involved that we must make them understand and uncover the roots of where [the movement] comes from, in order that we can know that those [who commit this offense of lèse majesté] misunderstand or they had the wrong information or they acted on rumor or sometimes as I understand rumors that is, there is some hiring from abroad to act and we can’t accept this. That is, acting with intent to do harm against the monarchy makes people misunderstand the monarchy.

I would like to ask that today, if His Majesty the King were really not good would the World Intellectual Property Organization honor him with a prize as a world leader in intellectual property? Or why does the international patent office in Hungary and South Korea award him prizes? It was for his intellect, invention of the water turbine, development, up to and including achievements in new theories and sufficiency economy, which are beneficial to the livelihoods of the inhabitants, of the people of Thailand.

Because of this then people who look at insulting the monarchy are held to have bad intentions for the King and any officials who remain indifferent ,well, are deemed to not be doing the right thing.

The Minister of Justice stated that government agencies to handle this matter are numerous. Gen. Anupongse Phaojinda, commander of the Army, assigned Army Region 1 to set up a special unit, or Chor Kor 6080 to keep track of the movement to violate the monarchy, including dissemination of electronic media or other types of communication to suppress the said movement, and not to allow it to grow any further.

When Pol.Gen. Patchawatwongse Suwan, National Police Commissioner, ordered the ICT to assign special staff to be responsible especially to be on the lookout to investigate any activities which fall within the scope of offenses, and urgently examine websites and various media that fall within the scope of lèse majesté, or inappropriate activity, that is, insulting to the monarchy.

Therefore, I need to have every government agency cooperate together to work as a team to arrange a new management process. Those concerned will come and discuss where the work is headed the wrong way. I won’t speak of any particular department or especially any single agency but I need to have cooperation working together in this matter…because when each separate part comes together we will then see obstacles and solve them as they are discovered. It won’t be long before the solution reaches the root of the movement. When we have succeeded we will be able to say that it was a cooperative success.

As to its name, at the moment we use the name Special Unit to Suppress and Solve Problems Relating to Offenses Against the Security of the Kingdom, whereas a law will be enacted to clearly support the task, to allow continuing work for a long time, no matter who in whichever political party becomes the government leadership in future, they will still have this agency. And they will be conscious of the protection not to allow cases that impact the kingdom’s security again, important for every single government administration.

Mr. Phirapant also stated that, In the past there have been continuous cases of apprehending offenders, but we don’t want them publicized, don’t want them in the public media. But let it be known that we are being serious, serious. That includes news reports about closing websites. I am displeased because I don’t want it to become news because I want to search out the network of offenders. But when news leaks out well it causes difficulties in investigation and thus now I have the commissioner being very careful.

As to why dealing with offending websites had been slow to now, the Minister stated that up to now there had only been one person handling the matter, but now there are numerous persons from the army who have come in and joined the work.

In this as far as the information I have received till now that we close webpages and websites and in the morning they bob up again. Same material.

The Minister hopes that the working group composed of the army, Ministry of Justice, the Office of the National Communications Board and ISPs who will monitor websites and check information that is placed on websites. This is like a water faucet. When you open the faucet water flows out. But we have to consider how to put a filter on the faucet so that it won’t flow out to users.

In this matter don’t just look at websites alone, because insulting the monarchy also includes speech on radio programs and television. This special unit will examine it all, because the offense of insulting the monarchy, if it appears on a website, it will be an offense classified as a computer crime and Criminal Code Article 112 applied to each instance of trespassing [against the monarchy] in violation of Article 112.

นาย พีระพันธุ์ สาลีรัฐวิภาค รัฐมนตรีว่าการกระทรวงยุติธรรม ประกาศเป็นนโยบายการบริหารงานกระทรวงยุติธรรม ในวันแรกที่เข้าทำงานในกระทรวงว่าจะเร่งดำเนินการปราบปรามคดีที่เกี่ยวข้อง กับสถาบันหลักของชาติ ไม่ว่าจะเป็นการกระทำ คำพูด การสื่อสารในรูปแบบใด หรือเว็บไซต์ อันนี้เป็นภารกิจสำคัญของกระทรวงยุติธรรม

ต่อมาศาลอาญา มีคำพิพากษาจำคุกนายแฮรี่ นิโคลายส์ (MR.Harry Nicolaides) อดีตนักข่าวและคอลัมนิสต์ชาวออสเตรเลีย เป็นเวลา 3 ปี ในข้อหาความผิดฐานหมิ่นประมาท ดูหมิ่น หรือแสดงความอาฆาตมาดร้ายพระมหากษัตริย์และรัชทายาท ตามประมวลกฎหมายอาญา มาตรา 112

วันนี้ผ่านมาแล้ว 1 เดือน นายพีระพันธุ์ สาลีรัฐวิภาค รัฐมนตรีว่าการกระทรวงยุติธรรม ให้สัมภาษณ์พิเศษ กรุงเทพธุรกิจ ถึงนโยบายจัดการขบวนการหมิ่นสถาบัน ทั้งผ่านทางเว็บไซต์ และสื่ออื่นๆ รวมถึงผู้ที่กระทำการหมิ่นเหม่และจาบจ้วงสถาบัน ว่า เวลานี้ต่างชาติเขาสับสนคิดว่าเรื่องแบบนี้เป็นสิทธิเสรีภาพ เพราะฉะนั้น สื่อ และผู้ที่เกี่ยวข้อง จะต้องทำความเข้าใจกับเขาใหม่ ว่า ความผิดต่อสถาบันนั้นเป็นความผิดต่อความมั่นคงในราชอาณาจักร มันไม่ใช่เรื่องของการแสดงความคิดเห็นหรือวิพากษ์วิจารณ์ธรรมดา แต่สื่อตะวันตก เขาไม่ผูกพันกับสถาบันหลักของพวกเขาอย่างเช่นคนไทยรู้สึกผูกพัน

รัฐมนตรีว่าการกระทรวงยุติธรรม บอกด้วยว่า ไม่ว่าต่างชาติหรือคนไทยก็ตาม จะต้องตระหนักตรงนี้ว่าถ้าประเทศไทยไม่มีสถาบันพระมหากษัตริย์ วันนี้ประเทศไทย ยังจะเป็นเช่นนี้หรือไม่ ดังนั้น ผมจึงมองว่า นี่คือ ปัญหาของความมั่นคงแห่งราชอาณาจักร ไม่ใช่เรื่องสิทธิเสรีภาพการแสดงความคิดเห็น ผู้ที่วิพากษ์วิจารณ์จึงไม่ใช่การกระทำผิดส่วนตัว แต่เป็นการกระทำผิดต่อความมั่นคงแห่งรัฐ

ทั้งนี้ ในเรื่องของความมั่นคงแห่งรัฐ แต่ละประเทศจะนิยามไว้แตกต่างกันไป แต่ละประเทศมีเหตุผลภายในแตกต่างกัน อย่างเช่น สหรัฐเขาจะมีเงื่อนไขในการเดินทางเข้าประเทศมากมาย เพราะเขาคิดว่านี่เป็นมาตรการที่จะทำให้ชาติเขามีความปลอดภัยจากภัยต่างๆ แต่สำหรับประเทศไทย เรากำหนดความผิดเรื่องการหมิ่นสถาบัน ไว้ในประมวลกฎหมายอาญา มาตรา 112 ว่าด้วยหมวดความมั่นคงของราชอาณาจักร

รัฐมนตรีว่าการกระทรวงยุติธรรม บอกไปถึงนักสิทธิมนุษยชนทั้งหลายว่า นักสิทธิมนุษยชน จะต้องคำนึงถึงเรื่องการละเมิดจิตใจ เพราะคนไทยนั้นเราจงรักภักดี และเทิดทูนสถาบัน เรามีความผูกพันทางใจยกให้เป็นพ่อ แม่ของแผ่นดิน ไม่ต้องอะไรมากแค่พ่อ แม่เราเอง ลองมีคนอื่นมาตะโกนด่าพ่อ ล้อแม่เรา เรายอมให้ทำอย่างนั้นหรือไม่

ขณะที่การวิพากษ์วิจารณ์ เราต้องดูว่าการกระทำว่าส่อเจตนาหรือไม่ ถ้าเจตนาที่จะหมิ่นพระบรมเดชานุภาพ ทำอย่างไรหรือพูดอย่างไรก็หมิ่น แต่ถ้าไม่มีเจตนา ทำอย่างไรก็ไม่ผิด เพราะกฎหมายอาญาในเรื่องคดีหมิ่นนั้น เกิดจากองค์ประกอบ คือ มีเจตนาพูดใส่ร้ายสถาบัน จงใจใส่ร้าย หรือเอาเรื่องไม่จริงมาพูด ฉะนั้น คนที่กระทำความผิดตรงนี้มีหลายแบบ เนื่องจากเขาได้ข้อมูลมาอย่างผิดๆ ซึ่งเราก็ต้องอธิบายให้เขาเข้าใจ แต่คนอีกประเภทหนึ่ง มีเจตนาที่จะทำลายสถาบันโดยตรง ด้วยการทำให้คนเข้าใจผิด ถ้าเป็นกรณีนี้ถือว่ามีเจตนาที่จะหมิ่นสถาบัน

เพราะฉะนั้น คนไทยที่เทิดทูนจงรักภักดีเขาก็มองว่าทำไมเจ้าหน้าที่ของรัฐมัวทำอะไรอยู่ จึงปล่อยให้คนนั้น คนนี้ มากล่าวหาพ่อ แม่ของแผ่นดิน จะเห็นว่า ในระยะ 2-3 ปีนี้ทำไมมันจึงกระพือ และผุดเป็นดอกเห็ด

นายพีระพันธุ์ ย้ำว่า แม้ว่าไทยเราจะเป็นประเทศเล็กๆ แต่เราก็มีวัฒนธรรมของเราเอง ถามว่าเราผิดไหม ตรงนี้ต่างชาติเขาเข้าใจเราผิด ผนวกกับมีการชี้นำผิดๆ ทำกันเป็นขบวนการ

ดังนั้น เป็นหน้าที่ของกระทรวงยุติธรรม และผู้ที่เกี่ยวข้อง จะต้องทำความเข้าใจ และหาต้นตอให้เจอว่ามันมาจากไหน เพื่อจะได้ทราบว่าคนที่เขาทำเขาเข้าใจผิด หรือเขาได้ข้อมูลผิดๆ มา หรือว่าเขาทำไปตามกระแส หรือบางครั้งที่ผมทราบเบาะแส ก็คือ มีการรับจ้างจากต่างชาติมาทำก็มี ที่รับไม่ได้คือการกระทำโดยเจตนามุ่งร้ายต่อสถาบัน ทำให้คนเข้าใจผิดในสถาบัน

ผมอยากถามว่าวันนี้ ถ้าองค์พระบาทสมเด็จพระเจ้าอยู่หัวไม่ดีจริง องค์การทรัพย์สินทางปัญญาโลก หรือ WIPO จะทูลเกล้าทูลกระหม่อมถวายเหรียญรางวัล ผู้นำโลกด้านทรัพย์สินทางปัญญา แด่พระบาทพระบาทสมเด็จพระเจ้าอยู่หัว หรือทำไม องค์กรสนับสนุนด้านการประดิษฐ์ระดับนานาชาติ ในฮังการี และ องค์กรการประดิษฐ์ เกาหลีใต้ จึงทูลเกล้าฯ ถวายรางวัลแด่พระบาทสมเด็จพระเจ้าอยู่หัว ที่ทรงพระปรีชาสามารถ ประดิษฐ์กังหันน้ำชัยพัฒนา รวมทั้งผลงานทฤษฎีใหม่และเศรษฐกิจพอเพียง อันเป็นประโยชน์ต่อการดำรงชีวิตของพสกนิกรชาวไทยอย่างยิ่ง พร้อมทั้งกำหนดให้ 2 กุมภาพันธ์ 2551 เป็น “วันนักประดิษฐ์โลก”

เพราะฉะนั้น คนที่จ้องจะดูหมิ่นสถาบัน ถือว่ามีเจตนาที่ไม่ดี และในส่วนของเจ้าหน้าที่ใครที่เพิกเฉย ก็ถือว่าทำไม่ถูกต้อง

รัฐมนตรีว่าการกระทรวงยุติธรรม บอกว่า หน่วยงานราชการที่ต้องจัดการเรื่องนี้มีจำนวนมาก (พล.อ.อนุพงษ์ เผ่าจินดา ผู้บัญชาการกองทัพบก มอบให้กองทัพภาคที่ 1 ตั้งชุดเฉพาะกิจ หรือ ฉก.6080 ติดตามขบวนการละเมิดสถาบันพระมหากษัตริย์ ทั้งการเผยแพร่ทางสื่ออิเล็กทรอนิกส์หรือสื่ออื่นๆ เพื่อยับยั้งการดำเนินการดังกล่าวไม่ให้ขยายตัวไปมากกว่านี้ ขณะที่ พล.ต.อ.พัชรวาท วงษ์สุวรรณ ผู้บัญชาการตำรวจแห่งชาติ สั่งให้สำนักเทคโนโลยีสารสนเทศและการสื่อสาร (สทส.) ตั้งเจ้าหน้าที่ผู้รับผิดชอบเป็นการเฉพาะเพื่อเฝ้าระวังติดตาม ตรวจสอบการกระทำที่เข้าข่ายความผิดและเร่งตรวจสอบเว็บไซต์ และสื่อต่างๆ ที่เข้าข่ายลักษณะความผิดฐานหมิ่นพระบรมเดชานุภาพ หรือกระทำการไม่เหมาะสม อันเป็นการดูหมิ่นสถาบัน กรมสอบสวนคดีพิเศษ กระทรวงยุติธรรม ตั้งวอร์รูมคดีหมิ่นสถาบัน กระทรวงไอซีที มีหน่วยเฝ้าระวังเว็บไซต์ไม่เหมาะสม) เพราะฉะนั้น ผมจึงต้องการให้ทุกส่วนราชการมาร่วมกันทำงานเป็นทีมให้มาจัดระบบการจัดการ ใหม่ คนที่ได้เกี่ยวข้องจะได้มาคุยกันว่างานติดขัดตรงไหน ผมจะไม่พูดถึงกรมไหน หรือหน่วยงานไหนเป็นการเฉพาะ แต่ผมต้องการเห็นการทำงานร่วมกันเพื่อเรื่องนี้โดยเฉพาะ เพราะเมื่อแต่ละส่วนได้มาทำงานกันแล้วก็จะเห็นอุปสรรค แล้วก็แก้ไขตรงจุดนั้น ไม่นานมันจะไปถึงการแก้ไขถึงต้นตอของเรื่อง เมื่อผลสำเร็จเราก็จะเรียกได้ว่าเป็นความสำเร็จร่วมกัน

ส่วนชื่อนั้น ขณะนี้ ใช้ชื่อว่า คณะทำงานชุดเฉพาะกิจปราบปรามแก้ไขปัญหาการกระทำผิดเกี่ยวกับความมั่นคงแห่ง ราชอาณาจักร โดยจะออกกฎหมายรองรับให้ชัดเจน เพื่อให้เกิดการทำงานอย่างต่อเนื่อง ยาวนาน ไม่ว่าใครจะพรรคการเมืองใด เข้ามาเป็นแกนนำจัดตั้งรัฐบาลครั้งต่อไป ก็ยังจะต้องคงมีหน่วยงานนี้ และตระหนักว่าการปกป้องไม่ให้เกิดคดีที่ส่งผลต่อความมั่นคงแห่งราชอาณาจักร เป็นความสำคัญจำเป็นของรัฐบาลชุดนั้นๆ

นายพีระพันธุ์ กล่าวด้วยว่า ที่ผ่านมา มีการจับกุมผู้กระทำความผิดโดยตลอด แต่เราไม่อยากให้เป็นข่าว ไม่อยากประชาสัมพันธ์ แต่ขอให้รู้ว่าเราเอาจริงเอาจัง รวมถึงข่าวการสั่งปิดเว็บไซต์ที่หมิ่นสถาบัน ผมไม่พอใจ เพราะไม่ต้องการที่จะให้เป็นข่าว เนื่องจากต้องการที่จะควานหาเครือข่ายผู้กระทำผิด แต่เมื่อมีข่าวออกไปก็ทำให้เกิดความลำบากในการสืบสวน สอบสวน ซึ่งขณะนี้ ได้กำชับผู้ใต้บังคับบัญชาให้ระมัดระวังแล้ว

ส่วนสาเหตุที่เกิดความล่าช้าในการจัดการกับเว็บไซต์หมิ่นสถาบันนั้น รัฐมนตรีว่าการกระทรวงยุติธรรม บอกว่า เพราะมีเจ้าหน้าที่ดำเนินการในเรื่องดังกล่าวเพียงคนเดียว แต่ตอนนี้เรากำลังจะเอาคนของกองทัพ ซึ่งมีอยู่จำนวนมากเข้ามาช่วยทำงาน

ทั้งนี้ เท่าที่ได้ข้อมูลในขณะนี้มีทั้งเว็บเพจ เว็บไซต์ เราปิดตรงนี้ วันรุ่งขึ้นก็ไปโผล่ที่ใหม่ เนื้อหาเดียวกัน

รัฐมนตรีว่าการกระทรวงยุติธรรม คาดหวังว่า คณะทำงานที่ประกอบด้วยคนของกองทัพ คนของกระทรวงไอซีที กระทรวงยุติธรรม รวมถึงสำนักงานคณะกรรมการกิจการโทรคมนาคมแห่งชาติ (กทช.) และ ISP หรือ Internet Service Provider ซึ่งจะดูแลเว็บไซต์และตรวจสอบข้อมูลที่จะผ่านออกไปลงในเว็บไซต์ ตรงนี้จะเหมือนก๊อกน้ำ เมื่อเปิดก๊อกน้ำน้ำจะมีตะกอนออกมา แต่เราจะต้องมาคิดว่าทำอย่างไร ก๊อกน้ำจะมีระบบกรองตะกอนไม่ให้ออกมาถึงผู้ใช้น้ำ

กรณีนี้ อย่ามองแค่เว็บไซต์อย่างเดียวนะครับ เพราะการหมิ่นสถาบัน รวมถึงหมิ่นด้วยคำพูดในรายการวิทยุ และโทรทัศน์ หน่วยงานนี้จะตรวจสอบทั้งหมด เพราะความผิดฐานหมิ่นสถาบันนั้น หากปรากฏในเว็บไซต์ ก็จะมีความผิดกฎหมายคอมพิวเตอร์ และประมวลกฎหมายอาญา มาตรา 112 แต่กรณีจาบจ้วงด้วยคำพูดนั้นผิด ประมวลกฎหมายอาญามาตรา 112

New Censorship: PM’s Empty Promises

Representatives from Freedom Against Censorship Thailand (FACT), Campaign for Popular Media Reform and Thai Netizen Network met with Prime Minister Abhisit Vejjajiva on January 13 to present an open letter of our concerns over Thailand’s censorship and lèse majesté laws.

However, Thailand’s censorship big bad wolf, the Ministry of “Information” and “Communication” Technology, has received court orders to block a further 445 websites.

And since that meeting an Australian novelist has been sentenced to six years for 103 words, a leading Thai academic has been charged over his book and the DSI chief himself led a raid to arrest a Thai engineer with a young family for surfing the Internet. All have been charged under Thailand’s Criminal Code Article 112 covering lèse majesté, carrying sentences of 15 years rather than being charged under the Computer-Related Crimes Act 2007 which would carry a maximum penalty of three years. It is apparent that Government’s “get tough” policy is merely vindictive.

December 4, 2008’s MICT blocklist of 37 webpages is actually appended to the original court order, requested by MICT’s Sathaporn Sonsena. All are online pharmacies selling “morning after pills” directed at Thai consumers in Thai.

These 37 are hardly the only online pharmacies to sell such medications commonly approved in many countries. The total number of online pharmacies is certainly in the tens of thousands.

However, it seems some of these URLs have a connection to Thailand, perhaps being operated by Thai owners or directed at Thai customers and with information in Thai and telephone numbers in Thailand. Has anyone ordered medications from any of these 37 pages from Thailand?

It looks as if the fundamentalists at MICT are making themselves Thailand’s morality police. Surely a “morning after pill” is preferable to our society’s health than unplanned pregnancies or backroom abortions.

January 14, 2009’s MICT blocklist comes as a result of the ministry’s application for court orders to block 408 separate web pages by MICT’s Thanit Prapatranan. With the exception of the Prachatai and Same Sky webboard fora, all blocked content are videos.

Most notable is a new video hosted in the Czech Republic, “Harry Nicolaides Is a Political Prisoner”.

Content previously on YouTube as part of the StopLeseMajeste channel has been diversified to 65 public video-sharing websites, most hosting multiple blocked videos. The sites are located in at least 12 identifiable countries.

25 further YouTube videos have been blocked as well as 31 YouTube pages in 23 countries. A single page at Google Video is also blocked.

Only a single new forum page at Prachatai is blocked but 14 more are blocked at Same Sky.

Once again, the ministry has failed to make its blocklists public nor admit to its application for court orders. In fact, the blocklists and court orders are stamped ลับ “SECRET”.

The Royal Thai Police now claim there remain “fewer than 100” websites undermining the monarchy. Does this mean there will be no further censorship???

The Justice Minister claims there are “more than 10,000”. FACT thinks this is just an excuse for more censorship.

Freedom Against Censorship Thailand (FACT) has grave doubts that Thai courts have taken the opportunity presented them to examine each webpage to determine whether each has lese majeste content from which the Thai public needs to be protected.

Much as Thailand’s red shirts and yellow shirts clashing on the streets of Bangkok, we are watching censorship devolve into a cat-and-mouse game between a huge Government ministry and a single YouTube Channel.

Aren’t there better ways to spend taxpayers’ money? Democracy does not exist for government in secret.

The Thai Senate announced on January 23 that it formed a committee that will monitor violations of lèse majesté and other related laws that protect the kingdom’s monarchy, media reports said.

The “Bangkok Post” reported on January 24 that the Senate voted to establish an “extraordinary committee” to strictly enforce laws related to the protection of the Thai king and the royal family.

The newspaper said the senate voted 90 to 17 in putting up this extraordinary panel which Thai sources explained is meant to monitor enforcement of laws like lèse majesté.

To be composed of 30 members, that is, 19 senators and 11 other officials, the committee will be headed by Thai national police chief Patcharawat Wongsuwan.

This development came as the Justice Ministry reported last week that over 10,000 websites contain messages insulting to the monarchy. According to the Information and Communication Ministry (ICT), 2,000 such websites have already been blocked.

Justice Minister Pirapan Salirathavibhaga said he would coordinate with the Foreign Ministry to instruct Thai embassies abroad to launch public relations campaign about lèse majesté.

Lèse majesté is a criminal offence in Thailand, and usually carries a 15-year prison term.

In a related development, this week’s edition of “The Economist” magazine has not been distributed in Thailand due to objections to an article about a lèse majesté case involving a foreign author.

According to the “Bangkok Post”, the article was about the recent conviction and sentencing of Australian author Harry Nicolaides to three years in jail for insulting the crown prince in his novel published in 2005.

In an email sent to its subscribers in Thailand, the magazine said, “This week our distributors in Thailand have decided not to deliver ‘The Economist’ in light of our coverage relating to the Thai monarchy.” .

Distributor bans Economist again

This week’s edition of The Economist has not been distributed in Thailand because of local objections to an article about the royal family, the second disruption in two months, the magazine says.

“This week our distributors in Thailand have decided not to deliver The Economist in light of our coverage relating to the Thai monarchy,” it said in an email to Bangkok-based subscribers.

The edition published on Friday focused on the case of Harry Nicolaides, an Australian author charged with lese majeste.

Nicolaides was sentenced to three years in jail last week for comments in a 2005 novel that were interpreted as a smear to the Crown Prince. Only seven copies of the novel were sold.

The Thailand distributor of The Economist magazine said Monday it had banned the latest edition of the news magazine, which carried a story about an Australian writer jailed for insulting the monarchy.

Discussing its second ban on the British publication in two months, an Asia Books staff member said the most recent issue was barred from shelves but declined to say why.

“Last Friday’s edition will not be on sale here, for reasons which I have not been informed about,” she told AFP news agency.

Asia Books in December pulled an edition of the Economist because it carried an article on the role of the royal family.

Friday’s publication carried an article about Harry Nicolaides, the Australian writer sentenced to three years in jail after pleading guilty last week to lese majeste, or slandering the royal family.

It discussed whether the lese majeste laws were being used to suppress dissent, rather than to protect the royal institution.

Asia Books withdrew the edition voluntarily, but Special Branch Police commander Pol Lt Gen Thiradet Rodphothong said his department was investigating and considering whether to issue an official ban.

Pol Lt Gen Thiradet added that he had asked all Thai distributors to help police screen content that could be considered offensive to the crown.

The Democrat Party government, which has come to power since the protests, has said protecting the institution. Among other actions, the government has censored some 4,000 websites oln the issue.

The crackdown on lèse majesté is intensifying as politics becomes polarised around the monarchy

 Years ago when this writer was a mass communication student at a Bangkok university, a senior editor of the English-language Bangkok Post was invited to speak about the editorial management of the daily.

The editor said the paper had once published a picture of Thailand’s King Bhumibol Adulyadej with a caption saying the king was ‘on vacation’. The next day, he received a phone call. The caller told him the caption was inaccurate: the king was never on vacation.

The Bangkok Post editor was not under any threat of being charged with defaming the king, but the incident explicitly demonstrates how sensitive a subject the monarchy is among Thai people.

The constitution states: ‘The king shall be enthroned in a position of revered worship and shall not be violated. No person shall expose the king to any sort of accusation or action.’ The king is, legally, above even the slightest criticism.

Defamation of the king or members of his family had not been a public issue for some time. Most Thais — as well as foreigners living in Thailand — know how to stay out of trouble. But since last year, the issue of lèse majesté has been taken up by the media like never before in modern Thai history.

In the past two weeks alone, Australian writer Harry Nicolaides was convicted of lèse majesté and started his three-year jail sentence in Bangkok, Thai political scientist Giles Ji Ungpakorn was charged with the same offence, and oil-rig engineer Suwicha Thakhor was detained without bail on similar charges.

Thai authorities have intensified their crackdown on individuals defaming the monarchy as loyalty to the king now polarises the political inclination of two opposing, confrontational blocs.

‘There really has been a large number of websites containing materials that could be seen as defaming the monarchy,’ Natthaphong Luangnaruedom, a regular blogger, told Index on Censorship. ‘But most of them use language that prevents them from being caught.’

Natthaphong was speaking at a panel discussion on ‘politics and the online world’ in Bangkok yesterday (25 January), where he publicly declared he is with the People’s Alliance for Democracy (PAD), whose supporters wear yellow shirts — a colour that is associated with the king. In Thailand, yellow is the colour of people born on Monday — the day of the week on which the king was born.

PAD supporters, seen as royalists, are also known to oppose former Prime Minister Thaksin Shinawatra. Critics consider Thaksin, in exile since his government was toppled by a military coup in September 2006, an anti-royalist.

His supporters have formed the red-clad Democratic Alliance Against Dictatorship (DAAD), which is currently moving against the Democrat Party-led government.

In addition to the three recent cases, many other Thais are either being charged with or prosecuted for defaming the monarchy.

The Ministry of Information and Communication Technology has said it has shut down more than 2,000 websites alleged to have contained lèse majesté material. And the minister has made the crackdown a policy priority.

The senate, on Friday 23 January, set up a committee tasked with addressing the issue, warning that over 10,000 websites could be the target of the campaign.

Lèse majesté is classified under ‘Offences Relating to the Security of the Kingdom’ in Thailand’s Penal Code. It has been part of the code and rarely subjected to change since its promulgation in 1957. Thai authorities treat lèse majesté as a matter of national security.

The offence carries a maximum penalty of 15 years in prison.

The Democrat Party, whose coalition government was formed in December 2008 with support from the royalist army, has legislation pending in parliament that will raise prison sentences for lèse majesté to a maximum of 25 years. The amendment will also add a maximum fine of one million baht (about USD $28,500). Currently, lèse majesté carries no fine.

The prescribed penalty and the recent intensification of suppression by Thai authorities have made the Thai public nervous. Many companies are known to have created firewalls to block suspicious websites or messages that might sneak into their computer systems, getting them and their employees in trouble.

The way in which the Thai police arrest lèse majesté suspects also adds to the current state of panic. They are known to have raided suspects’ homes at night, seizing computers and other assets. Many suspects have been detained with no prospect of bail.

The latest Thai to be accused of lèse majesté, oil-rig engineer Suwicha Thakhor, was arrested on 14 January by police as he and his wife were shopping in his hometown in the northeastern Nakhon Phanom province. The police also raided his other home in Bangkok, which he was accused of using as a base for spreading material defaming the monarchy.

He was interrogated by police without a lawyer present as he was persuaded that his cooperation would lead to his release. However, he has been detained by police since his arrest.

Suwicha, who has three children, has now been sacked by his employer without any severance, a direct result of having been charged with a serious crime.

‘What I want to know is: “Did I kill someone?”’ he has said. ‘I have seen suspects who killed people or raped young children released on bail. Some prominent individuals who faced charges similar to mine were released on bail. But I have not been granted bail. What is the standard on this issue?’

In an interview, he told a local website: ‘All my email messages have been read. They have set up a task force with a most wanted list, whose members they are trying to link into a network. I never thought Thailand would turn into this.’

In early January, India’s coast guard happened upon a wooden barge, half-sinking into the Bay of Bengal.

It was packed with roughly 100 people — frail, starving and stateless. According to reports, they’d fled refugee camps near the Burmese-Bangladesh border, pushed east toward wealthier lands and drifted near Thailand’s touristed island chains.

There, they claim, Thailand’s navy intercepted their boat, detained them in filthy conditions for a week, tossed several bound men into the open sea and finally set their barge adrift in international waters — with no sail, scarcely any food and little hope of survival. They floated aimlessly for 15 days.

Such is the latest indignity for the Rohingya people.

There are about 1 million Rohingya, with roughly 800,000 living along Burma’s coast and another 200,000 or so in refugee camps across the Bangladeshi border. They are Sunni Muslims and ethnic kin of Bengalis, who are also copper-skinned and speak a similar pitchy tongue.

They were once citizens of a lush kingdom stretching across modern-day Burma’s coastline. But, in 1784, Burmans invaded and sent them fleeing towards Bengali territory. Since then, they have been ground down by the British empire, natural disasters and Burmese dictators. Even in their ancestral homeland, human rights groups say, they are sporadically tortured, dragged into forced labor drives and denied citizenship.

And so they continue to flee.

“The Burmese objective is a clean sweep to make it a Muslim-free region,” said Numul Islam, an exiled Rohingya heading the Arakan Rohingya National Organization in London. “We are stateless in our own country. So we have nothing to lose.”

The Indian coast guard’s discovery of the drifting, would-be Rohingya refugees — and their bizarre claims of abuse at the hands of Thailand’s navy — has triggered scattered reports from around Southeast Asia. The Rohingyas rescued in the Bay of Bengal have given interviews to the Bangkok-based Arakan Project, headed by long-time pro-Rohingya activist Chris Lewa.

According to interview transcripts with rescued Rohingyas provided by Lewa, the 400 or so refugees were cut loose in international waters with only four bags of rice and little fresh water. Only 100 were rescued, with the rest assumed dead.

Starving, some Rohingya were lulled into the ocean by a distant light on the 10th day, according to the interviews. Fearing they would “lose the land forever,” hunger-wracked Rohingyas attempted to swim to the horizon.

“We saw many drowning, one by one, as the current was carrying them away and none of them had any energy left to swim,” one Rohingya told Arakan Project.

Thailand’s official figures show a rising number of intercepted Rohingya refugees, with more than 4,800 picked up through 2007 to 2008, up from about 2,700 the previous 12 months. As Thailand’s foreign ministry investigates, Prime Minister Abhisit Vejjajiva has insisted that no inhumane treatment is taking place.

“We don’t have a policy to violate human rights,” Abhisit told reporters.

Human rights watchdog groups, however, claim Thai seamen have pushed refugees back into the sea before. Rohingyas who washed onto Indonesian shores have made similar claims. Hong Kongi’s South China Morning Post published photos, shot by tourists, of detained Rohingyas lined up in rows at “Donald Duck Bay,” part of the heavily touristed Similan islands. Though the pictures resemble other photos of Rohingya detentions released by Thailand’s navy itself, the tourists claim these refugees were whipped in plain sight.

“The way they’re treated, it’s very questionable,” Islam said. “All these people in a boat, without any water, totally indebted to the sea and left to die … it’s very objectionable.”

The United Nations High Court of Refugees is now investigating the Rohingya’s treatment in Thailand. For now, they have the prime minister’s blessing, but Abhisit has pushed them to confront the problem at its source: Burma.

For Rohingya — forced to society’s margins in their native Burma — the sea is one of the only places they can flee. The Burmese junta, lumping them in with Bengalis across the border, casts them as Muslim invaders who belong in Bangladesh. British colonialists who created the river border between Burma and Bangladesh, illogically dividing Rohingya-Bengali territory, have inadvertently helped support the junta’s claim.

“Some would say they’re all illegal immigrants of Bangladesh,” said Bertil Lintner, an author and Burma expert based in Thailand. “But they’ve been there for hundreds of years, long before Bangladesh even existed.”

Rohingya, unlike other oppressed minorities in Burma such as the Karen or Shan, lack a well-funded rebel force to defend against junta offensives. The few fledgling Rohingya rebel groups are mostly concentrated in Bangladesh border country, Lintner said.

Some were swept under the Taliban’s wing and sent to fight U.S. forces in Afghanistan, Lintner has reported. But even in Afghanistan, the Rohingya were given back-breaking and dangerous jobs: toting supplies and sweeping for mines.

Thai fears that refugee Rohingyas will fall in with Islamic militants waging a separatist war in Thailand’s deep south are misguided, Lintner said. “These are people looking for jobs,” he said. “Nothing else.”

In a better world, Islam said, Rohingyas would return to their historic home and live “as responsible citizens of Burma.” But as long as the junta’s cruelty persists, and the Rohingyas remain unwanted by all of Asia, this unwanted tribe will continue wandering the seas in search of better lands.

And Burma’s Rohingya problem will again wash onto Thai shores.
